Alan D. Halperin, the Plan Administrator in the Century 21 bankruptcy cases secured a major victory in how rejection damages are calculated. Contrary to standing precedent, the Bankruptcy Court adopted the “rent” based calculation urged by the Plan Administrator thereby reducing the total claims against the estate.
