Alan Halperin, as Plan Administrator for the Wind-Down Estate of Briggs & Stratton Corporation won summary judgment in the Wisconsin Circuit Court for Milwaukee County against a conglomeration of major general liability insurance carriers for breach of contract. The case focused on policy provisions requiring the carriers to indemnify Briggs for “all sums” incurred by it as a result of asbestos injury claims made against Briggs. The Insurers argued that an email they issued in 2003 to which Briggs was not a party somehow modified their obligations under the relevant policies and justified their underpaying Briggs millions of dollars less than required under the policies. The Court rejected the carriers’ arguments in toto.
